UG Maps Terms & Conditions Policy

UG Maps / E-GIS Terms & Conditions of Use Policy

The below policy governs employee use of Interactive Web Mapper application called UG Maps, a service of the Unified Government's Enterprise GIS (E-GIS) project.

Instructions

Before using UG Maps you must read and understand the following carefully.

Section I. Data Limitations

1. UG Maps maps are expected to be used internally for display and reference purposes only. UG Maps provides an interface similar to a desktop GIS, however, this application is considered a GIS viewer and not a fully functional GIS.

2. Cadastral (parcel) information is not survey quality and should not be used for legal decisions or notices. Any planimetric information (streets, sidewalks, railroads, water features, etc.) is not necessarily accurate to engineering, survey, or navigational standards. The user is responsible for understanding the accuracy limitations of this data.

3. Assessed property values may not necessarily be certified values for ad valorem tax purposes.

4. GIS data layers come from a variety of sources and lineage and may not align perfectly when overlaid with one another.

5. You, the user, must exercise good judgment when acting upon this information in discharging work duties, or in passing along this information verbally or graphically to the public. UG Maps data should always be independently verified with original (primary) data sources for accuracy/currency/completeness if circumstances (such as possible economic loss, physical injury risk, etc.) require it.

6. Metadata (documentation about GIS datasets) is provided in UG Maps. Be sure to read it.

7. Technical staff may update, modify, remove, or revise application data at any time without notice, and assumes no responsibility to maintain them in any manner or form.

Section II. Kansas Open Records Act

1. A section of the Kansas Criminal Code related to the Kansas Open Records Act states in part:

"No person shall knowingly sell, give or receive, for the purpose of selling or offering for sale, any property or service to persons listed therein, any list of names and addresses contained therein, or derived from public records..." K.S.A. 21-3914. Violation of this law is a Class C Misdemeanor and can subject the violator to prosecution and imprisonment up to 30 days and a fine of $500.00. Violators will be reported for prosecution. By using this application, the user makes the following certification pursuant to K.S.A. 45-220(c)(2): "the requester does not intend to, and will not: (A) Use any list of names or addresses contained in or derived from the records or information for the purpose of selling or offering for sale any property or service to any person listed or to any person who resides at any address listed; or (B) sell, give or otherwise make available to any person any list of names or addresses contained in or derived from the records or information the purpose of allowing that person to sell or offer for sale any property or service to any person listed or to any person who resides at any address listed."

2. If you provide UG Maps-generated lists, you must have the person you provide them to sign the Open Records affidavit (a sworn statement form found on UG Maps Home Page) certifying the three statements contained in that Open Records affidavit.

Section III. Data Disclaimer

1. UG Maps Data is provided "as is" without warranty or any representation of accuracy, timeliness or completeness. The burden for determining accuracy, completeness, timeliness, merchantability and fitness for or the appropriateness for use rests solely on the user. The Unified Government makes no warranties, express or implied, as to the use of UG Maps Data. There are no implied warranties of merchantability or fitness for a particular purpose. The user acknowledges and accepts the limitations of the Data, including the fact that the Data is dynamic and is in a constant state of maintenance, correction and update.

2. You understand that there may be errors or omissions in data or programming in this application, and that correction of defects is not guaranteed. If you find any errors please bring them to UG Maps technical staff's attention.

3. Flood Hazards Disclaimer:

The flood data shown on this map identifies potential flood hazard areas. The information is the best available digital data but, it is not the official FEMA D-FIRM and should not be used for insurance purposes. Please consult the printed FEMA D-FIRM maps as the official source. Check with your city’s floodplain administrator for updated information.

4. Zoning Disclaimer:

The zoning information provided by this Web site is based on data created by the Urban Planning and Land Use Department of the Unified Government, Wyandotte County, Kansas City, Kansas. All information is provided as a public service and should be utilized at the user's own risk. This map shall not be used to author any contracts or exchanges. The map is presented as a snapshot of the city’s zoning at the time it was printed or uploaded to the internet and shall not in any way be interpreted as the “Official Zoning Map” of the City of Kansas City, Kansas. This map is not updated in real time with the publication of new zoning map amendments.

The Official Zoning Map can be viewed at the offices of The Urban Planning and Land Use Department. 701 North 7th Street Room 423.

5. Sanitary Sewer Disclaimer:

The sewer data shown is for reference only and should not be used as authenticated data for design criteria. All information is provided as a public service, and the Unified Government in no way guarantees its accuracy and fitness for any particular purpose and expressly disclaims any representation of warranty as to the completeness, accuracy, or suitability of the data or information. All information must be field verified and shall not be sold or released to or shared with other parties without prior written permission from the Unified Government.

Section IV. Data Usage Restrictions

1. All digital GIS data found on UG Maps is copyrighted intellectual property of the Unified Government. Any downloaded GIS data in digital form (i.e. shapefile format) shall not be sold or released to third parties without the express permission of UG Geospatial Services Staff located at Base Mapping/GIS.

2. There are no restrictions on distribution of printed UG Maps maps, other than the UG copyright/credit notice should be legible on the print. Furnishers of UG Maps maps to the public are also advised to provide a copy of this Terms & Conditions document to each map recipient.

Section V. Service Availability

1. This mapping service may become temporarily unavailable due to circumstances such as power failure, network repair, or system maintenance. UG Maps staff will work to restore service as quickly as possible in these situations. However, do not create dependencies on this mapping service for mission critical needs.

2. If you are using a non-recommended web browser this application may not display or operate properly.

Section VI. Privacy Policy

Policies concerning the release of information about individuals have yet to be written. Because of privacy interests of individual property owners and in view of possible liability incurred in releasing of identifiable information, users should consult UG Legal Department attorneys before releasing any information concerning identifiable property owners.

Section VII. This Is Subject to Any Future E-GIS Information Policy

This Terms & Condition Policy is liable to change as warranted, and shall be subject to any future official E-GIS Information Policy that may be adopted by the UG.
